1. Eligibility & Accounts

Welcome to WebTechs, a software service operated by BMS Group LLC (“WebTechs”, “we”, “us”, or “our”). These Terms of Use (“Terms”) govern your access and use of WebTechs’ platform, applications, services, and websites (collectively, the “Services”). By creating an account, accessing, or using the Services, you agree to these Terms. If you do not agree, you may not use the Services.

1. Eligibility & Accounts

1.1 You must be at least 18 years of age to use the Services or have the consent of a parent or guardian if under 18.

1.2 When creating an account, you agree to provide accurate and complete information and to keep that information current.

1.3 You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.

2. Use of Services

2.1 You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations.

2.2 You may not use the Services in a way that could damage, disable, overburden, or impair WebTechs’ servers or networks.

2.3 WebTechs may, at its sole discretion, suspend or terminate your account if you violate these Terms or misuse the Services.

3. Content & Ownership

3.1 All software, code, designs, and other materials provided by WebTechs remain the property of BMS Group LLC and are protected by intellectual property laws.

3.2 You retain ownership of any content (text, images, data, etc.) that you upload to the platform but grant WebTechs a limited license to use such content solely to provide the Services.

3.3 You are solely responsible for the legality, accuracy, and appropriateness of any content you upload or distribute through the Services.

4. Third-Party Services

4.1 WebTechs integrate with third-party services (e.g., Stripe for payment processing, background check providers, messaging services).

4.2 By using these integrations, you agree to the terms and conditions of those third-party providers.

4.3 WebTechs is not responsible for outages, errors, or data loss caused by third-party platforms.

5. Payment & Refunds

5.1 Premium Services

When using a paid premium service or plan, you must provide accurate billing information. You will be billed annually or monthly, on or around the date of your account creation, at your selected plan rate or separately agreed upon rate, one month in advance until you cancel the service, unless otherwise agreed in writing. WebTechs does not provide refunds for unused time, partial months, pro-rated periods, or disruptions caused by third-party providers. Accounts past due are subject to suspension.

5.2 Registration Services

Organizations using our registration services agree that payments processed by credit card will incur a non-refundable processing fee at the posted or agreed-upon rate. Collected registration fees are paid directly to your organization via Stripe, less any applicable minimum balances, typically within 1–3 business days. To issue an online refund, your account must have a balance equal to or greater than the refund amount; otherwise, you must refund participants offline.

5.3 Additional Fees

Any additional third-party fees (including background checks, evaluation services, national/ regional membership API fees, or other partner services) are solely your responsibility and will be passed directly to you.

5.4 Team or Participant Registration

Fees for registration are set and collected by the organization. Refunds are handled by the organization in accordance with their policy. Because processing fees are incurred on registrations, full refunds may not be possible. WebTechs (BMS Group LLC) is not responsible for issuing refunds and chargebacks are prohibited.

6. Data & Privacy

6.1 WebTechs collects and processes data in accordance with our Privacy Policy.

6.2 By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.

6.3 You are responsible for ensuring that any data you collect from your participants or users complies with all applicable privacy and data protection laws.

7. Service Availability

7.1 WebTechs strives to provide continuous service but does not guarantee 100% uptime.

7.2 Scheduled maintenance, unforeseen outages, or third-party disruptions may temporarily affect access to the Services.

7.3 WebTechs is not liable for damages caused by downtime or service interruptions.

8. Limitation of Liability

8.1 To the maximum extent permitted by law, WebTechs is not liable for indirect, incidental, or consequential damages, including loss of data, revenue, or business opportunities.

8.2 In no event shall WebTechs’ total liability exceed the amount paid by you in the past 12 months for the Services.

9. Indemnification

You agree to indemnify and hold harmless WebTechs (BMS Group LLC), its employees, officers, and affiliates from any claims, damages, or liabilities arising from your use of the Services, violation of these Terms, or infringement of any rights of third parties.

10. Termination

10.1 You may cancel your account at any time.

10.2 WebTechs reserves the right to suspend or terminate your account if you breach these Terms or misuse the Services.

10.3 Upon termination, your access will be revoked and any outstanding fees remain payable.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.

12. Changes to Terms

WebTechs may update these Terms from time to time. Notice of material changes will be provided through the platform or email. Continued use of the Services after updates constitutes acceptance of the revised Terms.
